Pa. Appellate Court Affirms Dismissal of Benzene Medical Monitoring Claims

HARRISBURG, Pa. –– A Pennsylvania appellate court has affirmed the dismissal of a medical monitoring claim in a benzene exposure suit, finding that the plaintiffs’ sole expert report did not meet the state’s requirements for asserting the cause of action.

In the June 9, five-page opinion, the Pennsylvania Superior Court opined that the trial court’s assessment of the expert report –– which failed to address the plaintiffs’ alleged exposure or quantify that exposure –– was thorough and proper.
