ST. LOUIS –– Harley-Davidson Inc. has filed its appellate brief in the U.S. Court of Appeals for the 8th Circuit, backing a district court’s decision to award it summary judgment on collateral estoppel grounds in a benzene case.
In its May 27 brief, Harley-Davidson additionally argued that Missouri’s collateral estoppel doctrine does not contain a fair or equitable requirement and that the plaintiffs had their chance to appeal the underlying decision in a previous suit, but chose not to do so.
