Defendants Oppose Plaintiff Summary Judgment Efforts, Say Case Involves Gasoline Exposure, Not Benzene Exposure

NEW ORLEANS –– Defendants named in a benzene suit have opposed a recent plaintiff motion for partial summary judgment, arguing that the motion seeks summary judgment on the “only relevant issue,” which is whether trace benzene exposure can cause acute myeloid leukemia.

In a May 27 brief filed in the U.S. District Court for the Eastern District of Louisiana, defendants Chevron U.S.A. Inc., Texaco Inc., and Shell Oil Co. maintained that the plaintiffs have failed to authenticate or prove a hearsay exception to a number of the documents they proffer in support of summary judgment.
