LAKE CHARLES, La. –– A Louisiana appellate court has denied the appeal of a former truck worker, finding that he had not presented enough evidence to support his workers’ compensation claim involving exposure to benzene, hydrogen sulfide and other toxic chemicals.
In the June 4 opinion, the Louisiana 3rd Circuit Court of Appeal noted that while the claimant contended that he needed more time to develop the causation record, the only medical report upon which he relied to support his claim was issued more than one year ago.
