Valero Files Intervening Complaint in Louisiana Benzene Action, Says It’s Entitled to Portion of Any Recovery

NEW ORLEANS –– Former employers of a benzene plaintiff have filed documents in the pending litigation, with one of the parties arguing that, as the decedent’s former employer, it is entitled to a portion of any amount the plaintiffs recover.
In a May 12 intervening complaint filed in the U.S. District Court for the Eastern District of Louisiana, Valero Refining-New Orleans LLC said it has already paid the decedent’s family death benefits under the state’s Workers’ Compensation Act.
