NEW ORLEANS –– Benzene plaintiffs in Louisiana have moved for partial summary judgment, asking the federal court to rule that there is no genuine issue of material fact challenging the argument that benzene can cause acute myeloid leukemia in humans.
In the April 9 motion, the plaintiffs additionally ask the U.S. District Court for the Eastern District of Louisiana to rule that the petroleum defendants knew that benzene could cause leukemia in humans prior to 1958 and that prior to the 1970s, the defendants failed to warn users of these dangers.
