Formosa Plastics Files Motion to Dismiss Recently Amended Fraud Claims in Benzene Case

NEW ORLEANS –– Benzene defendant Formosa Plastics has moved to dismiss recently amended fraud claims, arguing that the cause of action still contains “generic allegations made against all defendants.”
The Feb. 27 motion filed in the U.S. District Court for the Eastern District of Louisiana says the plaintiffs once again fail to plead specific facts as to each defendant.
“Plaintiffs newly added fraud allegations against Formosa are once again lumped together with their fraud allegations against all other defendants,” the motion states. “Such ‘group pleading’ is impermissible under Rule 9(b).”
