PHILADELPHIA –– Benzene defendant U.S. Steel has asked a Pennsylvania trial court to apply New York case law, noting that the alleged exposure occurred in New York and that there is a conflict of law between the two states.
In the Jan. 6 motion, filed in the Pennsylvania Court of Common Pleas for Philadelphia County, U.S. Steel argues that New York and Pennsylvania law differ on a bulk supplier’s duty to warn.
