Defendant Removes Missouri Benzene Action Asserting Exposure While Working on Lawn Equipment

KANSAS CITY, Mo. –– A defendant in a Missouri benzene action has removed the case to federal court, saying that the only non-diverse defendants named in the action have been voluntarily dismissed.

Golden Eagle Co. removed the case, which asserts allegations of exposure while servicing lawn and garden equipment, on Nov. 12 to the U.S. District Court for the Western District of Missouri.

Wade Wiederhold filed the complaint, contending that he was exposed to benzene-containing products while working in trucking and lawn and garden equipment industries. As a result of the exposure, the plaintiff says he developed acute promyelocytic leukemia.
