Minn. Federal Court Denies Insurer’s Attempts to Intervene in Benzene Coverage Dispute

MINNEAPOLIS –– An insurer’s efforts to intervene in a benzene-related dispute have been denied by a Minnesota federal court, after the court found that the insurer had “no more than a tangential or collateral interest” in the issues.

In the Aug. 29 order, the U.S. District Court for the District of Minnesota found that the Westchester Fire Insurance Co.’s interests were represented through the insurance company already involved in the case.

“Westchester has not demonstrated that it is entitled to intervene in this action as a matter of right or that permissive intervention is warranted,” the court concluded.
