Benzene Plaintiffs Oppose Motion to Dismiss; Say Details Defendants Seek Better Suited for Discovery

NEW ORLEANS –– Plaintiffs asserting benzene claims have opposed a motion to dismiss, saying that the details the defendants request are more appropriate for discovery and arguing that their complaint establishes issues of fact.
In an Aug. 12 reply brief filed in the U.S. District Court for the Eastern District of Louisiana, however, the defendants who filed the motion to dismiss maintain that the claims are time-barred.
The plaintiffs filed the action on behalf of Kevin Boudreaux, who was allegedly exposed to benzene-containing products while working as an instrument technician and maintenance worker at a variety of construction sites.
