Missouri Court Reinstates PCBs Claim Against Pharmacia, Says Harm was Foreseeable

ST. LOUIS –– A Missouri appellate court has reversed an award of summary judgment for Pharmacia in a PCBs case, ruling that the plaintiffs had presented sufficient facts to support their claims that the defendant’s product could have caused their individual injuries.

In the July 24 decision, the Eastern District of the Missouri Court of Appeals opined that questions of foreseeability and proximate cause should be determined by a factfinder, not the court.
