Philadelphia Defendants Maintain Position that Benzene Case Belongs in New York

PHILADELPHIA –– U.S. Steel Corp., Sunoco Inc. and Radiator Specialty have supported their motion to dismiss a Pennsylvania benzene case on forum grounds, arguing that the location of defense headquarters is “irrelevant” to the discussion.

However, in a sur-reply filed July 26 in the Pennsylvania Court of Commons Pleas for Philadelphia County, the plaintiffs argued that the defendant has “misunderstood and misapplied” the law.

“Incredulously, Defendant attempts to convince the court that the location of the Defendants’ headquarters in Philadelphia, Bucks County and Pennsylvania is an irrelevant consideration,” the sur-reply states.
