Shell Defendants Says Benzene Claims Are Untimely; Say Plaintiff Can’t Invoke Discovery Rule without Reasons

NEW ORLEANS –– Shell Oil Co. and Shell Chemical LP have moved to dismiss a Louisiana benzene complaint, contending that the plaintiffs’ claims are time-barred since the lawsuit was not filed until more than seven years after the decedent’s death.

In a July 29 motion filed in the U.S. District Court for the Eastern District of Louisiana, the Shell defendants specifically contend that the plaintiffs have failed to establish that the interruption or suspension of prescription was justified.
