Benzene Defendants Move to Dismiss New Lawsuit, Say Claims are Untimely

NEW ORLEANS –– Five benzene defendants have moved to dismiss a recently filed complaint in Louisiana, in part arguing that the claims are barred by the state’s statute of limitations on wrongful death actions.
In a series of motions filed July 24 in the U.S. District Court for the Eastern District of Louisiana, ExxonMobil, Dow Chemical, CF Industries, Shell Oil Co., and Shell Chemical LP all moved to dismiss the complaint for failure to state a claim upon which relief could be granted.
