NEW ORLEANS –– The U.S. Court of Appeals for the 5th Circuit has denied a plaintiff request for oral argument in the appeal of their recently dismissed benzene claims, according to a recent order issued by the court.

In a one-page order issued July 18, U.S. Circuit Judge Thomas M. Reavley denied the plaintiffs’ motion, which had argued that oral argument would “assist the court in evaluating the scientific issues concerning the exclusion of expert testimony based on the complex factual circumstances in this case.”
