NEW ORLEANS –– Defendant Kinder Morgan Bulk Terminals Inc., as a successor-in-interest to GATX Terminals Corp., argues in an opposition to a benzene plaintiff’s motion for partial summary judgment that a fact issue still exists as to whether GATX provided the former tankerman with adequate warnings.
In a supplemental opposition filed July 18 in the U.S. District Court for the Eastern District of Louisiana, the defendant maintains that it has never admitted that it failed to provide the plaintiff with warnings.
