Pa. Court Refuses to Amend CMO, Rejects Defense Motion to Have Benzene Plaintiff Answer Product Identification Questionnaire

PHILADELPHIA –– A judge has denied defense efforts to require benzene plaintiffs with claims pending in Pennsylvania state court to complete a joint product identification questionnaire within 30 days of the court’s order.

In a one-page order issued July 8, the Philadelphia Court of Common Pleas for Philadelphia County denied the motion to amend the case management order, in which defendants sought the requirement of product identification sheets in order to “streamline” the written discovery process.
