Benzene Plaintiffs Back Claims Against Executive Officers; Say They Are Not Pursuing Radiation, Welding Fume Claims

NEW ORLEANS –– Plaintiffs in a benzene case have opposed a motion for partial summary judgment asserted by Texaco Downstream Properties Inc., maintaining that claims for strict liability, fraud, misrepresentation and concealment asserted against executive officers are valid.

In the June 18 opposition brief filed with the U.S. District Court for the Eastern District of Louisiana, however, the plaintiffs explained that they have not pursued their claims relating to radiation exposure since they were unable to document exposure to Technologically Enhanced Radioactive Material (TERM).
