NEW ORLEANS –– A plaintiff in a benzene action pending in Louisiana has filed motions for partial summary judgment as to affirmative defenses proffered by Valero (NYSE:VLO) and Kinder Morgan, saying that it is uncontested that the defendants did not provide warnings to the plaintiff.

On June 14, the plaintiff filed two partial summary judgment motions in the U.S. District Court for the Eastern District of Louisiana, seeking to strike several defenses proffered by the defendants.
