International Paint Says District Court was ‘Justifiably’ Concerned about Expert Testimony when Dismissing Benzene Claims

NEW ORLEANS –– Benzene defendant International Paint has filed its brief with the U.S. Court of Appeals for the 5th Circuit, supporting a district court decision that dismissed benzene claims on grounds that the plaintiffs’ expert testimony was inadmissible.
In their June 10 brief, International Paint maintained that the plaintiffs had no causation evidence linking its products to the plaintiffs’ development of multiple myeloma since plaintiff expert Dr. Bhaskar Kura failed to properly calculate contamination levels of benzene in the defendant’s products.
