Missouri Court Allows Benzene Plaintiffs to File Third Amended Complaint

ST. LOUIS –– A Missouri court has allowed plaintiffs in a benzene lawsuit to file a third amended complaint, which the plaintiffs contend would cure product identification deficiencies.

In a June 13 one-page order, the U.S. District Court for the Eastern District of Missouri also denied several defense motions to dismiss the second amended lawsuit.

Regardless of the plaintiffs’ assurances that a third amended complaint would clarify product identification issues, The Steco Corp. continued to argue for dismissal, saying that the plaintiffs have still failed to mention the type of Steco product that caused the plaintiff’s injuries.
