Texaco Seeks Partial Summary Judgment in Benzene Case, Dismissal of Radiation, Welding Fume Claims

NEW ORLEANS –– A Texaco benzene defendant has asked a Louisiana federal court to award it partial summary judgment, arguing that the plaintiff never intended to pursue claims related to alleged radiation or welding fume exposures against the defendant.

In its June 11 motion, Texaco Downstream Properties Inc. asks the U.S. District Court for the Eastern District of Louisiana to dismiss the plaintiffs’ strict liability claim in addition to their claim for concealment, misrepresentation and fraud.
