Plaintiffs Seek to Amend Missouri Action, Say Amended Lawsuit Could Cure Deficiencies Named in Recent Motions to Dismiss

ST. LOUIS –– Plaintiffs in a benzene lawsuit have asked a Missouri court to allow them leave to file an amended complaint, saying that while the latest version of the lawsuit has prompted several defendants to file motions to dismiss, a third amended complaint could clarify the product identification deficiencies.
In a June 5 order, the U.S. District Court for the Eastern District of Missouri granted a separate unopposed motion filed by the plaintiffs seeking extra time to respond to Sherwin-Williams’ motion to dismiss. The order gives them until June 20 to file their brief.
