WD-40, Citgo Seek to Dismiss Missouri Benzene Action on Product Identification Grounds

ST. LOUIS –– Several defendants named in a benzene lawsuit –– including WD-40 and Citgo Petroleum –– have filed motions to dismiss, saying that the second amended complaint does not meet pleadings standards under Missouri law.

In separate motions filed May 13-17 in the U.S. District Court for the Eastern District of Missouri, the defendants argue that the plaintiffs “must do more with respect to product identification.”

The claims were filed on behalf of Franklin Linton Jr., whose acute myelogenous leukemia was allegedly caused by exposure to benzene-containing products. Linton was employed in a variety of positions, including as a …
