Philadelphia Plaintiffs File Suggestion of Death in Mechanic Benzene Case

PHILADELPHIA –– Plaintiffs in a Pennsylvania benzene case have filed a suggestion of death, noting that the former mechanic whose illness prompted the suit has passed away.

According to the March 21 document, filed in the Pennsylvania Court of Common Pleas for Philadelphia County, the decedent’s widow “has qualified as executrix of the last will and testament of David Butler.”

David Butler and his wife, Teri Rhodes, filed the lawsuit after David Butler developed Myelodysplastic Syndrome and Acute Myelogenous Leukemia. The illnesses were caused, Butler contended, by exposure to benzene-containing products he worked with while employed as a mechanic for …
