WINSTON-SALEM, N.C. -- Two manufacturers of allegedly defective products have filed motions to dismiss a third-party complaint asserted against them, arguing that the lawsuit has no merit. Stromberg, et al. v. Thermo Fisher Scientific Inc., et al. v. ExxonMobil Chemical, et al., No. 07-332 (M.D. N.C.).
However, in separate motions to dismiss filed recently in the U.S. District Court for the Middle District of North Carolina, the two defendants claim that Thermo Fisher Scientific Inc.'s third-party complaint fails to state a claim upon which relief can be granted.
