RALEIGH –– A North Carolina appellate court has affirmed the denial of benefits to a former Chemtek worker, noting that it could not, on appeal, reweigh evidence presented to the North Carolina Industrial Commission.
In the Nov. 1 ruling, the North Carolina Court of Appeals denied the plaintiff’s appeal of the dismissal of his case, but remanded the case for a determination of whether the defendant is entitled to sanctions.
