Del. Court Allows Claims to Proceed Against Sherwin-Williams, Limits Time Frame

WILMINGTON, Del. -- A Delaware court has denied efforts by Sherwin-Williams to dismiss benzene-related claims asserted against the manufacturer of paint products but has limited the time periods in which the plaintiff can contend the exposures occurred. Heddinger, et al. v. Ashland Oil Inc., et al., No. 06C-05-295 BEN (Del. Super. Ct., New Castle Cty.).
In the Jan. 13 opinion, the Delaware Superior Court for New Castle County ultimately determined that it could not conclude that the plaintiff was not exposed to Sherwin-Williams products in some capacity and that this exposure did not cause his injuries.
