CAMDEN, N.J. -- The representatives for the estate of a U.S. Marine have filed a motion to remand in New Jersey federal court, contending that the defendants have failed to prove that the location of the alleged benzene exposure was a federal enclave. Cacoilo, et al. v. The Sherwin Williams Co., et al., No. 11-07039 (D. N.J.).
In the Jan. 3 motion filed in the U.S. District Court for the District of New Jersey, the plaintiffs argue that the United States did not "acquire and maintain exclusive jurisdiction over the land" on which the decedent was allegedly exposed.
