WASHINGTON, D.C. -- The U.S. Supreme Court has denied a petition for writ of certiorari in a benzene case, opting not to address defendants had claimed were inconsistent positions on whether hypotheses-based testimony is admissible, according to an order released moments ago. U.S. Steel Corp., et al., v. Milward, et ux., No. 10A1263 (U.S. Sup. Ct.).

The nation's highest court weighed the merits of the petition at a conference on Jan. 6, according to the court's online docket. In the filing, the defendants claimed that there were significant gaps in evidence and flaws in reasoning in the plaintiffs' expert testimony. …
