Veterans Claims Court Reverses Denial of Benefits in Benzene-Related Multiple Myeloma Case

WASHINGTON, D.C. -- A Veterans' Claims appellate court has remanded a multiple myeloma claim for benefits, finding that the lower panels erred when they did not consider the claimant's potential exposure to benzene at the Camp Lejeune Marine Corps Base in North Carolina. Polanco v. Eric K. Shinseki, No. 09-1603 (U.S. Ct. App., Veterans Claims).
In the Oct. 28 ruling, the U.S. Court of Appeals for Veterans Claims rejected the other grounds for the plaintiff's appeal of the denial of benefits, but ultimately ruled that the plaintiff should be permitted to submit additional evidence to back his claims.
