Benzene Defendants File Brief with U.S. Supreme Court in Causation Dispute

WASHINGTON, D.C. -- Defendants involved in a benzene case have filed a brief with the nation's highest court, contesting a 1st Circuit Court of Appeals decision that reinstated claims linking benzene exposure to the development of acute promyelocytic leukemia. U.S. Steel Corp., et al., v. Milward, et ux., No. 10A1263 (U.S. Sup. Ct.).

In the September brief, the defendants contend that the trial court was correct when it found that there were significant gaps in evidence and flaws in reasoning in the plaintiffs' expert testimony.
