DALLAS -- A Texas jury has reached a defense verdict in favor of Rust-Oleum in a benzene case, rejecting the plaintiff's claims that the defendant's paint thinner was a substantial contributing factor to his development of acute myelogenous leukemia. Khieu, et al. v. Rust-Oleum Corp., et al., No. 08-10425 (Texas 193rd Dist. Ct., Dallas Cty.).
The Texas 193rd District Court for Dallas County jury reached the verdict after three-and-a-half hours of deliberations on Aug. 13, sources told HarrisMartin. Judge Carl Ginsberg presided over the eight-day trial, in which Rust-Oleum was the lone remaining defendant.
