CAMDEN, N.J. –– Defendant Complimentary Coatings Corp. has backed its motion to dismiss, contending that the plaintiffs have not brought sufficient factual allegations to state a plausible claim against the defendant. Cacoilo, et al. v. The Sherwin Williams Co., et al., No. 11-07039 (D. N.J.).

In an opposition brief filed June 18 with the U.S. District Court for the District of New Jersey, however, the plaintiffs argue that, at this stage of the litigation, their complaint is sufficiently pled.

The underlying lawsuit involves claims asserted on behalf of Nilton Cacoilo, who was a member of the U.S. Marine Corps. …
