NEW ORLEANS -- A Louisiana federal court has denied a motion for summary judgment by a benzene defendant, ruling that the motion was premature without further discovery. Scioneaux, et al. v. Elevating Boats LLC, et al., No. 10-0133 (E.D. La.).
In the June 25 ruling, the U.S. District Court for the Eastern District of Louisiana said that until the defendant produces information relating to the decedent's work history, it cannot weigh in on whether summary judgment is appropriate.
The claims were asserted on behalf of Antonie Scioneaux, who was allegedly exposed to benzene while working for Elevating Boats, LLC. …
