NEW ORLEANS -- Plaintiffs in a Louisiana benzene lawsuit have opposed efforts by defendants to dismiss the claims, contending that the complaint does in fact properly plead misrepresentation claims. Wagoner, et al. v. ExxonMobil Corp., et al., No. 09-07257 (E.D. La.).

The opposition was in response to a May 28 motion for partial dismissal filed by Shell Oil Products Co. and ExxonMobil Corp. in the U.S. District Court for the Eastern District of Louisiana, in which the defendants claimed that the claims were not pled with sufficient particularity.
