SMITHLAND, Ky. -- Parties in a complaint linking benzene exposure to the development of myelodysplasia are scheduled to hold a status conference in June, sources told HarrisMartin Publishing. Fryer v. Apex Oil Co., No. 06-CI-00170 (Ky. Cir. Ct., Livingston Cty.).

In the amended complaint, filed recently in the Kentucky Circuit Court for Livingston County, the plaintiff notes that James H. Fryer died on April 7, 2009, and Nancy C. Fryer has been appointed the executrix of his estate.

Given those circumstances, the plaintiffs have added a cause of action for wrongful death in the amended lawsuit.
