Court Remands Complaint after Plaintiffs Admit Radiation-Related Claims Fail

CHICAGO -- An Illinois federal court has remanded a benzene lawsuit that also included radiation exposure allegations after the plaintiffs acknowledged that the federal radiation claims were not supported by sufficient evidence. Hite, et al. v. Apex Oil Co., et al., No. 09-3454 (N.D. Ill.).
In a one-page docket entry filed March 23, the U.S. District Court for the Northern District of Illinois granted the plaintiff motion to remand without comment.
The plaintiffs contend that William P. Hite was exposed to benzene while working as a pipefitter for two years at Apex Oil Co.'s premises.
