LAKE CHARLES, La. -- A benzene plaintiff in Louisiana has asked a federal court to remand his claims, contending that his lawsuit was improperly removed as the executive officers of the defendant in question are citizens of Louisiana. Hargrove v. Bridgestone/Firestone North American Tire, No. 10-00318 (W.D. La.).
In a March 23 motion to remand filed with the U.S. District Court for the Western District of Louisiana, plaintiff Johnny Harlan Hargrove additionally argues that the removal is procedurally defective because it was filed more than 30 days after the defendant was served.
