BOSTON -- Plaintiffs attempting to connect benzene exposure to the development of acute promyelocytic leukemia have filed their opening brief in which they contest a district court ruling precluding the plaintiffs' general causation testimony as inadmissible. Milward v. Acuity Specialty Products Group Inc., No. 09-2270 (1st Cir.).
In the Feb. 23 brief filed in the U.S. Court of Appeals for the 1st Circuit, the plaintiffs maintain that oral argument in the proceedings is necessary because there are hundreds of pages of scientific articles and exhibits relating to the issue of whether benzene exposure can cause APL.
