CINCINNATI -- Parties in an Ohio benzene case involving both personal injury and property damage claims are asking the federal court that dismissed a portion of those claims to determine if its ruling is a final, appealable order. Baker, et al. v. Chevron USA Inc., et al., No. 05-227 (S.D. Ohio).

In a Feb. 5 opposition filed this month in the U.S. District Court for the Southern District of Ohio, the defendants challenge the plaintiff's motion for final judgment, arguing that because some claims still exist, the appeal should be delayed until all the claims in the proceedings are resolved. …
