Judge Denies Defense Motion to Preclude Testimony in MDS/AML Case

GALVESTON, Texas -- A Texas trial court has denied attempts to challenge plaintiff experts in a benzene MDS/AML case, rejecting Union Carbide's contention that the testimony failed because it did not utilize well-accepted methodology. Hall, et al. v. Radiator Specialty, et al., No. 08-CV-0161 (Texas 56th Jud. Dist. Ct., Galveston Cty.).
In a one-page order issued Feb. 19, the Texas 56th Judicial District Court for Galveston County denied the motion to exclude the causation opinions, and further denied the defendant's no-evidence motion for summary judgment.
