Plaintiff Challenges Defense Experts, Says they Changed Diagnosis

NEW ORLEANS -- A plaintiff in a myelodysplastic syndrome case has challenged the admissibility of three defense expert witnesses, claiming that one of the experts changed the diagnosis entirely. Barrois, et al. v. Firemand's Fund Insurance, et al., No. 09-380 (E.D. La.).
In a series of motions filed Jan. 21 and 26 in the U.S. District Court for the Eastern District of Louisiana, the plaintiffs argue that the defense experts fail to cite references, fail to read reports of plaintiff experts and their opinions are not accepted by the scientific and medical community.
