BEAUMONT, Texas -- Stating that the underlying case "is not ready for trial," DuPont has filed an unopposed motion for continuance in a benzene case involving the claims of a former automotive painter. Smith, et al. v. E.I. du Pont de Nemours and Co. Inc., et al., No. 08-00385 (E.D. Texas).
In the Nov. 5 document filed in the U.S. District Court for the Eastern District of Texas, the defendant also moves to amend the scheduling order, noting that the plaintiffs recently added another defendant, who has yet to make an appearance or file an answer.
