Court Declines Defense Motion to Reconsider Sophisticated User Decision

OMAHA, Neb. -- A Nebraska federal court has denied a defense motion to reconsider a sophisticated user ruling, in which the court declined to apply the doctrine in the benzene case. Vondra, et al. v. Barton Solvents Inc., et al., No. 07-85 (D. Neb.).

In its one-page Oct. 20 ruling, the U.S. District Court for the District of Nebraska said that there were factual issues that needed to be resolved before the legal issues could be addressed.
