Court Finds Expert Testimony Inadmissible, Enters Judgment for Defendant

RIVERSIDE, Calif. -- A California federal court has rejected the testimony of a benzene expert, finding that because the plaintiff had failed to prove that the chemical agents were present in the product he used, the expert's attempt to link the chemicals to the plaintiffs' bladder cancer fails. O'Neill v. The Sherwin-Williams Co., No. 08-368 (C.D. Calif.).
In the Sept. 9 opinion, the U.S. District Court for the Central District of California said that theories proffered by the plaintiff's expert were speculative and could not withstand factual representations provided by the defendant.
