Mo. Defendants Seek to Strike Affidavits of Fact Witnesses

ST. LOUIS -- Defendants in a Missouri benzene action have filed a motion to strike the affidavits of two fact witnesses that were allegedly executed more than two years before they were disclosed. Whitehead v. Baxter Healthcare Corp., et al., No. 08-0421 (E.D. Mo.).

On Aug. 20, in a motion filed in the U.S. District Court for the Eastern District of Missouri, defendants Ashland Inc. and Univar USA Inc. sought to strike the affidavits of Richard Fry and Kenneth Hasekemp.
