Court Excludes Mention of Aplastic Anemia, Allows Reference to Myelofibrosis

NEW ORLEANS -- A federal court has restricted the scope of a benzene plaintiff's claims, ruling that experts testifying on his behalf will not be permitted to state that myelofibrosis is a form of aplastica anemia or that the plaintiff has aplastic anemia. LeBlanc, et al. v. Chevron USA Inc., et al., No. 05-5485 (E.D. La.).

In the July 15 order, the U.S. District Court for the Eastern District of Louisiana did find there to be sufficient evidence linking myelofibrosis and benzene exposure and will permit plaintiff experts to testify as to this causal link.
