Kentucky Federal Court Dismisses Technical Products from Benzene Action

LEXINGTON, Ky. -- A Kentucky district court has granted a benzene defendant's motion to dismiss, ruling that the plaintiffs failed to refute the defendant's contention that it did not distribute any products after 1997. Watkins, et al. v. Safety-Kleen Inc., et al., No. 08-224 (E.D. Ky.).

In the July 27 opinion, the U.S. District Court for the Eastern District of Kentucky opined the "uncontradicted evidence is that Technical Products did not exist after 1997 and did not distribute anything after 1997." The plaintiffs contends that exposure to the defendant's chemicals occurred between 2001 and 2007.
